DMV Hearings

Tallahasee DUI Attorney

At the law offices of Jansen and Davis, P.A., we provide aggressive representation to people who have been charged with drunk driving in Tallahassee.  A lawyer can be helpful for a number of different reasons and will assist you through all phases of the DUI process, including the DMV hearing.  A DMV hearing is a hearing which is held at the Department of Motor Vehicles regarding the suspension of your driver’s license.  Individuals who are charged and convicted of DUI will almost always face license suspension as part of their sentence.  The DMV hearing will be held to determine whether or not you will retain your driving privileges following an arrest for DUI.

After being arrested and charged with DUI in Florida, you have 10 days to request a DMV hearing, otherwise your Florida driver’s license will be automatically suspended.  The DMV hearing will focus on the various police and chemical test reports, and will be presided over by an employee of the Department of Motor Vehicles.  There are a number of issues that will be raised during the DMV hearing to help the judge decide whether or not your license should be suspended:

  • Were you driving the vehicle?
  • Were you legally stopped by the officer?
  • Were you legally arrested by the officer?
  • Did you take a test and was it done properly under the law?
  • Did you have a blood alcohol level above the legal limit?
