After being arrested and charged with DUI in Florida, you have 10 days to request a DMV hearing, otherwise your Florida driver’s license will be automatically suspended.  The DMV hearing will focus on the various police and chemical test reports, and will be presided over by an employee of the Department of Motor Vehicles.  There are a number of issues that will be raised during the DMV hearing to help the judge decide whether or not your license should be suspended:

  • Were you driving the vehicle?
  • Were you legally stopped by the officer?
  • Were you legally arrested by the officer?
  • Did you take a test and was it done properly under the law?
  • Did you have a blood alcohol level above the legal limit?
